“Public hearing before the Zoning Board of Appeals Village of Barrington Hills Text Amendment – Special Uses, Section 5-6-4(C) Notice is hereby given that a Public Hearing will be held on Monday, July 18, 2022 at 6:30 p.m. by the Zoning Board of Appeals of the Village of Barrington Hills at the Village Hall, 112 Algonquin Road, Barrington Hills, concerning an application filed by MKES Investments, LLC, 32W939 Algonquin Road, Barrington Hills, IL, which requests a text amendment to Section 5-6-4(C) Special Uses of the Zoning Ordinance to include, in the list of Special Uses in the B-3 zoning district, “Daycare.”
A copy of the Zoning Ordinance and the application for the text amendment is available for examination by appointment at the office of the Village Clerk at the Village Hall, 112 Algonquin Road, weekdays between 9:00 a.m. and 5:00 p.m.
The agenda, and meeting packet containing the text amendment application and copy of this notice will be posted no later than the end of the day on Friday, July 15, 2022 at www.vbhil.gov. I supported changing this property to B3 when I was on the ZBA because it made sense under VBH Code given the type of structure and its geographical location. I do not support expansion of the definition of B3 to include daycare. It makes no sense. Daycare is more akin to schooling than it is a business use.
Further, the line of sight for entering and existing this property with heavy and fast traffic coming from the East and West is too dangerous as currently configured for parents and their children. A serious accident waiting to happen.
If the VBH wants “daycare” to be included in the Code, it is a better fit under R1 as a “special use” to be included with its close cousins “Schools and Churches”; already there. As a special use, the Village would maintain greater oversight and control over the facility housing children.
The focus of VBH representatives should be fidelity to the Code by maintaining its integrity through consistency; not altering it for every Tom, Dick and Mary who seek a use for their property which is different from those uses allowed when they purchased it.
Be wary of the law of unintended consequences.
I agree consistency in application of the code is important in our village. Some property owners don’t even bother to seek approval for a significant change in use different from those uses allowed when they purchased it! And permits – who needs those!
