Village faces another equestrian related lawsuit

The Village of Barrington Hills now faces another equestrian related legal battle due to a lawsuit filed by a resident over property rights related to the keeping of horses.  Walter Dale “Rick” Hardy III filed suit in Cook County Circuit Court against members of the Zoning Board of Appeals and several neighboring residents on November 4, 2011.

The compliant stems from the rejection by the ZBA of a “special use permit” application Hardy submitted for the construction of a horse stable on his property at 104 Brinker Road.  At their September 19, 2011 meeting, the Zoning Board voted 5 to 2 to deny the application after hearing and considering hours of testimony.

According to the lawsuit, Hardy believes the ZBA decision, “… was against manifest weight of evidence presented at the hearing,” and asks that the court overturn the decision of the ZBA.

Hardy, a significant “Save 5 Acres” contributor, made news earlier this year when he blocked a driveway leading to a neighbor’s home with horse fencing (see Gentlemen’s agreement fractures, and so does homeowner’s driveway).
